'Marital rape not legal offence': HC quashes Section 377 case against husband
Posted
The Delhi high court has dismissed an order to prosecute a husband under Section 377 for "unnatural" sex with his wife, citing the marital rape exception and contradictions in the wife's statements. The court emphasized that Section 377 doesn't apply to non-penile-vaginal intercourse within marriage, especially without explicit lack of consent.
