Trial court not the first stop for investigation, says Supreme Court
نشر بتاريخ
The Supreme Court has ruled that trial courts cannot directly entertain complaints seeking police investigation of cognisable offences. Before approaching a court, individuals must first seek FIR registration with the jurisdictional police. Magistrates should direct informants to approach the officer-in-charge and then the Superintendent of Police before considering applications under Section 156(3) of the CrPC.
