USCIS updates policy on CSPA age calculation for H-1B children: Here’s why thousands may lose green card eligibility after turning 21
Posted
USCIS has updated its policy on Child Status Protection Act (CSPA) age calculation, now using the Final Action Dates chart from the Department of State’s Visa Bulletin for visa availability. The change, effective for requests filed from August 15, 2025, affects thousands of immigrant children, especially from India and China, who may lose green card eligibility upon turning 21. The update aims to standardise age calculation and reduce discrepancies between applicants inside and outside the US.
