In a blow to Terrorists & their Sympathisers, Supreme Court has ruled that “Bail is a Rule & Jail an Exception” Principle WILL NOT APPLY in UAPA cases. SC also declared that “Bail must be REJECTED as a Rule” should apply in UAPA cases unless Accused is able to prove his innocence Prima Facie.

Furthermore, it added that Mere Delay in trial of UAPA case is NO GROUND to grant bail in grave offences under the anti-terror law.

SC's decision came on appeal filed by Gurwinder Singh, part of proscribed Terrorist group that include Canada-based Gurpatwant Singh Pannun.
