सर्वोच्चको फैसलाले एनआरएनएको भविष्य संकटमा

सर्वोच्च अदालतले समानान्तर एनआरएनए खोल्न सक्ने फैसला गरेको छ । यस फैसला पछि एनआरएनएमा अब के होला भन्ने कौतुहलता बढेको छ । गैरआवासीय नेपाली सम्बन्धि ऐनको दफा १६ र नियमावलीको दफा १२ मा कम्तिमा २५ देशमा बसोबास गर्ने ५० जना गैरआवासीय नेपालीहरुको निवेदन दिएमा संघ दर्ता गर्न सकिने व्यवस्था गरिएको छ । यसै दफालाई टेकेर एनआरएनका पुर्व उपाध्यक्ष सोनाम लामाले एनआरएनए जस्तै सँस्था दर्ता गर्न परराष्ट्र मन्त्रालयमा निवेदन दिएका थिए । यस निवेदनबारे मन्त्रालयले कुनै जवाफ नदिए पछि लामाले सर्वोच्चको ढोका ढकढकाएका थिए । ऐनमा नै एक भन्दा बढि एनआरएनए जस्ता सँस्था दर्ता गर्न पाउने खालको भाव भएकोले कुनै न कुनै बेला अर्को सँस्था दर्ता हुनेछ भन्ने आशंका पहिले नै थियो । त्यो समय अहिले आएको मात्र हो ।

सर्वोच्चको फैसलाले लामाको सँस्था मात्र होईन अब एनआरएनए बाग्लुङ समाज, एनआरएनए गुल्मी समाज, काग्रेस एनआरएनए, एमाले एनआरएनएले, माओवादी एनआरएनए जस्ता सँस्था खोल्ने बाटो खुलेको छ । हालका परराष्ट्र मन्त्री विदेशमा खोलेका सबै नेपाली संस्थाहरुसँग सहकार्य गर्न सकिने बिचार राख्नु हुन्छ भन्ने सुन्नमा आएको छ । सर्वोच्चको फैसलाले उहाँको बिचारलाई मलजल गरेको छ । के परराष्ट्रले यस्ता संस्थाहरुको नियमन गरेर बसि रहन सक्छ? के एनआरएनए जस्ता सँस्था परराष्ट्रमा नै दर्ता हुनु पर्छ? विष्लेषण गरौ।

गत चुनावमा परराष्ट्रले गरेको राजनितिक हस्तक्षेप पछि केही साथीहरुले एनआरएनए परराष्ट्र मन्त्रालयबाट झिक्नु पर्ने र विदेशमा दर्ता गरेर चलाउनु पर्ने धारणा राखेका थिए । अब टोले, दले, झोले एनआरएनए खोल्ने भए पछि परराष्ट्रमा बस्नु वा नबस्नु कुनै अर्थ नरहने भयो । गैरआवासीय नेपाली नागरिकताको व्यवस्था हुनु पुर्व परराष्ट्रमा दर्ता गर्नु पर्ने वाध्यात्मक परिस्थिति थियो । किनभने नेपालमा सँस्था दर्ता गर्न नेपाली नागरिक हुनु पर्थ्यौ । विदेशी नागरिकता लिने एनआरएनको नेपाली नागरिकता कायम नरहने हुनाले एनआरएन कार्ड लिएर परराष्ट्रमा सँस्था दर्ता गर्ने सकिने विशेष व्यवस्था गरिएको थियो । अहिलेको संविधानले गैरआवासीय नेपाली नागरिकताको व्यवस्था गरेकोले यसै नागरिकताको आधारमा आम नेपाली सरह सँस्था दर्ता गराउन सक्छन् । अतः अहिले संशोधन हुदै गरेको गैरआवासीय नेपाली सम्बन्धि ऐनमा भएको परराष्ट्रमा संघ दर्ता गर्न सकिने व्यवस्था खारेज गरिनु पर्छ वा एक मात्र एनआरएनले दर्ता गर्न सकिने व्यवस्था ऐनमा गरिनु पर्छ ।

वास्तामा अहिले प्रस्तावित ऐनमा एक मात्र एनआरएनएको परिकल्पना गरिएको थियो । यसलाई हटाउन तत्कालिन (हालका पनि) सत्तारुढ दलका नेताहरु नै लागेका थिए । यसका लागि उनीहरु नजिकका एनआरएनका नेता मार्फत लबि गरेका थिए । यो अनौठो पनि थिएन किनभने उनीहरुलाई पहिले नै लागेको थियो कि आफ्नो दलको एनआरएन कुनै पनि बेला खोल्नु पर्ने परिस्थिति आउने छ । एनआरएनएको नेता बन्न दलका नेताहरुको ढोका चार्न जाने साथीहरुले यी नेताहरुको बिचारको विरोध गर्ने नैतिक क्षमता राख्न सक्दैनथे । सर्वोच्चले पनि आज यिनै नेताको धारणालाई बल पुरायो । Source: Hem Raj Sharma
